1. Scope
This Privacy Policy describes how Lotustay Inc. (“Operator,” “we,” “us,” or “our”) collects, uses, and shares information in connection with the Lotustay Exchange website and waitlist only.
At this stage, the Site is a soft-launch / informational waitlist. We collect name and email for early-access updates. There is no live trading, membership portal, or financial product account on this Site at this time.
If we later launch additional services, we will update this Policy (and, where appropriate, provide additional notices).

We do not currently require you to create a passworded account to join the waitlist.
2.3 We do not intentionally collect
Sensitive personal information (as defined under California law) for waitlist purposes, payment card data for trading, government ID numbers, or precise geolocation for the waitlist form—unless you voluntarily include such information in a free-text message (please do not).
3. How We Use Information (Purposes)
We use the information above to:
- Manage the waitlist and send early-access / launch updates related to Lotustay Exchange
- Operate, maintain, and improve the Site
- Protect security and integrity (fraud/abuse prevention, debugging)
- Respond to your requests and communications
- Comply with law and enforce our terms
We do not sell your personal information.
We do not “share” personal information for cross-context behavioral advertising as those terms are commonly used under the California Consumer Privacy Act (CCPA/CPRA), by default for this waitlist stage. If that ever changes, we will update this Policy and provide required opt-out mechanisms.

Service providers / processors: We may share information with vendors who help us run the Site (e.g., email delivery, website hosting, form tools, analytics if used). They are instructed to process data only for our purposes under contract.
We do not use waitlist data to train public AI models or for unrelated marketing lists without a lawful basis and, where required, your consent or an opt-out opportunity.
5. Your Privacy Rights (California and Good-Faith Access)
Depending on where you live and whether Operator meets applicable “business” thresholds under California law, you may have rights to:
- Know / access the personal information we hold about you
- Delete personal information (subject to legal exceptions)
- Correct inaccurate personal information
- Opt out of sale or sharing (we state we do not sell/share by default for this waitlist)
- Limit use of sensitive personal information (we do not seek sensitive PI for the waitlist)
- Non-discrimination for exercising privacy rights
How to exercise: Email tommymai@tmaifinancial.com with the subject line “Privacy Request” and tell us what you want (access, delete, correct, etc.). We may need to verify your identity (e.g., confirming control of the email on the waitlist).
Note: Full CCPA/CPRA “business” obligations may or may not apply depending on Operator size and revenue thresholds. Even so, Operator intends to honor reasonable access, correction, and deletion requests for waitlist data in good faith.
Authorized agents (where the law allows) may submit requests; we may require proof of authorization and direct verification with you.
6. Cookies and Analytics (Optional / If Used)
If we use cookies, local storage, or third-party analytics (for example, a privacy-respecting analytics tool or basic hosting logs):
- Essential: Needed for security and basic Site function
- Analytics (if enabled): Help us understand aggregate traffic
You can control cookies through your browser settings. Blocking some cookies may affect Site features. We will update this section if we deploy named analytics or advertising technologies.
7. Children
The Site and waitlist are intended for individuals 18 years of age or older. We do not knowingly collect personal information from children under 13. If you believe a child under 13 provided information, contact tommymai@tmaifinancial.com and we will delete it.
8. Retention
We keep waitlist information:
- Until the soft-launch / waitlist period ends or you ask us to delete your information; and
- Thereafter for a reasonable archive period as needed for security, dispute resolution, legal compliance, and backup integrity—then we delete or de-identify it.
9. Security
We use reasonable administrative, technical, and organizational measures appropriate to a simple waitlist site. No method of transmission or storage is 100% secure.
10. Third-Party Sites
The Site may link to third-party sites (including Lotustay.com). Their privacy practices are their own; this Policy does not cover them.
11. International Visitors
The Site is operated with a California / United States focus. If you access it from elsewhere, you understand your information may be processed in the United States.
12. Changes
We may update this Policy from time to time. We will post the revised version on the Site and update the Effective Date. Material changes affecting the waitlist may also be highlighted by email if appropriate.
